£30,000 for Nurse Following Assault by Senior Colleague

In January 2024 we were instructed by a client to peruse a claim for damages against her employer following an assault in the work place by a senior colleague. Jack Dowling dealt with this matter.


Our client, a nurse in her mid-20s, was the victim of a campaign of sexual harassment in the workplace by a nurse colleague which culminated in a physical assault in December 2023. Despite our client escalating her concerns on numerous occasions to management, the matter was not formally dealt with until said colleague pulled our client's scrubs down in a storeroom in front of other colleagues.


We sent a letter of claim to the Defendant Trust in April 2023 alleging that they had failed in their duty of care to our client in that they did not act appropriately once they were aware of the situation.

 
Following negotiations, the Defendant Trust, without admission of liability, agreed to settle the matter for £30,000.


The perpetrator was convicted of sexual assault which was later reduced to assault on appeal.
